Copyright Infringement Policy
Nefxi Technologies ("Nefxi") respects intellectual property rights and expects all users of its platform to do the same. This policy describes how we respond to notices of alleged copyright infringement under the applicable Kenyan copyright law and internationally recognised DMCA principles.
1. Our Commitment
We are committed to: • Responding promptly to valid notices of copyright infringement • Removing or disabling access to infringing content • Implementing a repeat infringer policy • Protecting the rights of both copyright holders and our users
2. Reporting Copyright Infringement
If you believe that content on Nefxi infringes your copyright, please submit a written notice to our Designated Copyright Agent containing the following: 1. Your full name, address, telephone number, and email address 2. A description of the copyrighted work you claim has been infringed 3. A description of the infringing content and its location on Nefxi (URL or listing ID) 4. A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law 5. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on the owner's behalf 6. 4. Our Response to Valid Notices
Upon receipt of a valid copyright infringement notice, Nefxi will: • Remove or disable access to the allegedly infringing content promptly • Notify the user who posted the content of the takedown • Provide the user with an opportunity to submit a counter-notice • Maintain a record of the notice for legal compliance purposes
5. Counter-Notices
If you believe your content was removed in error or that you have the right to post it, you may submit a counter-notice to our Copyright Agent containing: 1. Your full name, address, telephone number, and email address 2. Identification of the removed content and its location before removal 3. A statement under penalty of perjury that you have a good-faith belief the content was removed by mistake or misidentification 4. A statement consenting to the jurisdiction of the Kenyan courts 5. Your physical or electronic signature Upon receipt of a valid counter-notice, we may restore the content within 10–14 business days unless the original complainant seeks a court order.
6. Repeat Infringers
Nefxi operates a strict repeat infringer policy. Users who receive multiple valid copyright infringement notices will have their accounts suspended or permanently terminated. Nefxi reserves the right to assess repeat infringer status at its sole discretion.
7. Trade Mark Infringement
Trade mark concerns are handled separately from copyright notices. If you believe a listing infringes your registered trade mark, please contact us at [email protected] with evidence of your trade mark registration and a description of the allegedly infringing listing.
8. Good Faith and Misuse
Submitting a false or misleading copyright notice is a serious matter. Knowingly submitting a materially false notice may expose you to civil liability. We reserve the right to pursue remedies against parties who abuse the reporting process.
